U.S. v. Tiede

86 FRD 227 (U.S. Court of Berlin 1979)

In this case, a criminal proceeding arising our of the alleged diversion of a Polish aircraft by the defendants from its scheduled landing in East Berlin to a forced landing in West Berlin, the United States exercised jurisdiction and convened the U.S. Court of Berlin to hear the matter. Judge Herb Stern ruled that the Constitution of the United States applied to the proceedings, and that friendly aliens, charged with civil offenses in a United States court in Berlin had a right to a jury trial.
